1. Agreement & Governing Law
These Terms and Conditions (“Terms”) constitute a legally binding agreement between Bear Water Industry (“Company”) and the customer (“Customer”). By renting, purchasing, or using any Company products or services, the Customer agrees to these Terms.
These Terms are governed by and construed in accordance with the laws of the State of California.
2. Rental Units – Month-to-Month
All rental units are provided on a month-to-month basis.
Customers may cancel at any time with a minimum of thirty (30) days written notice.
If service is canceled without 30 days notice, a $100 equipment pickup fee will apply.
If proper 30-day notice is provided, the pickup fee is reduced to $50.
Rental charges continue until equipment is retrieved by the Company.
3. Equipment Pickup & Condition
Customer agrees to provide reasonable access for equipment pickup.
Equipment must be returned in normal working condition, excluding reasonable wear and tear.
Damage, loss, or misuse may result in additional charges.
4. Parts and Installation Fees
A $125 parts and installation fee applies to service calls, repairs, or replacements unless otherwise stated in writing.
5. Products & Manufacturing
Bear Water Industry (BWI) products, including Bear Water Industry Reverse Osmosis systems, Deionizer systems and Bernardo Home System are assembled in San Diego, California
6. Warranty – 12-Month Limited Warranty
All Bear Water Industry products include a 12-month limited warranty beginning on the date of installation or delivery.
This warranty covers defects in materials and workmanship under normal residential use.
This warranty does not cover misuse, improper installation, unauthorized modification, water conditions outside specifications, or consumable items such as filters and membranes.
Warranty service is limited to repair or replacement at the Company’s discretion.
7. Payments & Late Fees
All charges are due as billed. Late or unpaid balances may result in service suspension, equipment removal, or additional fees as permitted by California law.
8. Limitation of Liability
To the maximum extent permitted by California law, the Company is not liable for indirect, incidental, or consequential damages.
9. Right to Refuse or Terminate Service
The Company reserves the right to refuse, suspend, or terminate service for non-payment, violations of these Terms, unsafe conditions, or equipment misuse.
10. Changes to Terms
The Company may update these Terms at any time. Continued use of services constitutes acceptance of revised Terms.
Returns:
Returns are accepted within 14 days of delivery or installation. Products must be unused, uninstalled, and in original condition, with all packaging and accessories included. Proof of purchase is required.
Non-Returnable Items:
Installed systems, used products, rental equipment, custom or special-order items, and consumable parts (filters, membranes, cartridges) are non-returnable, except as required by law.
Valid Reasons for Return:
Returns may be approved for damaged, defective, or incorrect products. Damage due to misuse, improper installation, or unsuitable water conditions is not eligible.
How to Start a Return:
Contact Bear Water Industry customer service to request authorization before returning any product. Unauthorized returns will not be accepted.
Refunds:
Approved refunds are issued to the original payment method within 7–14 business days after inspection. Shipping, installation, and service fees are non-refundable unless required by California law.
Warranty:
Products covered under the 12-month limited warranty may be repaired or replaced rather than refunded.
